General Terms and Conditions (GTC) and Scope of Application

These General Terms and Conditions govern the contractual relationship between ARGE NÖ Bergerlebnispass, consisting of the lift companies listed at the end of these GTC (hereinafter referred to as the “Member Operators”), and natural persons (hereinafter referred to as the “Customer or Pass Holder”) who purchase the NÖ Bergerlebnispass. By purchasing and using the NÖ Bergerlebnispass, the Customer expressly accepts these GTC. In addition, the conditions of carriage of the respective Member Operator whose lift and/or piste facilities – including ancillary facilities – are actually used by the holder of the NÖ Bergerlebnispass shall apply.

1. Eligibility to Purchase and Use of the NÖ Bergerlebnispass

  • In principle, all persons are entitled to purchase the NÖ Bergerlebnispass. The standard rate according to the price list shall apply.
  • There is no entitlement to the issue of a free NÖ Bergerlebnispass for small children (this refers to children who, based on their date of birth, do not yet fall within the year-of-birth limits for children’s passes according to the NÖ Bergerlebnispass price list).
    If an adult within a family group purchases a NÖ Bergerlebnispass, children under the age of 6 within the family group shall receive the MINI-Bergerlebnispass.
    The individual fare regulations of the respective ski resorts shall therefore apply to the transport of small children.
  • The applicable years of birth and age categories for the individual categories can be found at www.bergerlebnispass.at.
  • Persons with a degree of disability of 70% or more are eligible for special rates (proof must be provided by presenting the original social insurance confirmation).
  • The NÖ Bergerlebnispass is valid for one person only and shall be issued exclusively upon payment of the purchase price and provision of the holder’s surname, first name, date of birth, address and a photograph. The photograph as well as the holder’s first name and surname shall be digitally printed in the designated field via the ticketing system.   • The pass is non-transferable, including between members of the same family.
  • The NÖ Bergerlebnispass is issued only on contactless data carriers. A Keycard costs EUR 5.00 and is issued against a refundable deposit. A functioning “Keycard ISO Dual” may also be reused in the following year. If a Keycard does not function, the data can be transferred to a new card; however, EUR 5.00 for the new card plus a processing fee of EUR 25.00 per newly issued card must also be paid. The EUR 5.00 deposit for the respective Keycard shall be refunded upon return of the undamaged data carrier at the ticket offices of the participating resorts. When using the facilities covered by the NÖ Bergerlebnispass, the Customer must carry the NÖ Bergerlebnispass at all times and present it upon request together with a valid photographic ID.

2. Purchase and Withdrawal

The pass may be purchased as follows:

  • Purchase directly at the ski resort: The Customer pays for and receives the desired NÖ Bergerlebnispass directly at the ticket office of a ski resort designated as a point of sale.
  • Purchase via webshop: Ski resorts participating in ARGE NÖ Bergerlebnispass may also offer the NÖ Bergerlebnispass for sale through their respective webshops. In the respective webshop, all personal data required for issuing the personalised pass shall be requested. Once the ordering process has been completed, the Customer shall receive an order summary and shall then have the option to complete the purchase by means of online payment. After successful payment, the Customer shall receive both the invoice and an order confirmation, including a collection code where applicable, at the email address provided. Using this collection code, the pass may be collected no later than 0.5 hours after purchase at any ticket office of the ski resort through whose webshop the Customer purchased the pass.
  • Purchase by email to info@bergerlebnispass.at: Once the data required for issuing the pass has been submitted to ARGE NÖ Bergerlebnispass by email, payment may be made by direct debit. The pass shall then be provided after receipt of payment in the same manner as described in the preceding paragraph.
  • Withdrawal from the purchase is generally excluded as set out in Section 3. Special conditions are set out in Section 8 regarding refunds.

3. Rates and Liability

  • The rates applicable to the respective season shall apply to the purchase of the NÖ Bergerlebnispass.
  • Subsequent exchange for another ski pass, transfer to another person or postponement of the validity period is not permitted.
  • The holder of the NÖ Bergerlebnispass is obliged to keep the pass secure and inaccessible to third parties in order to prevent misuse, loss and theft.
  • No entitlement to a refund exists in the event of bad weather, departure, illness (except as provided for in Section 6), avalanche risk, failure or interruption of operations, or closure of ski runs.
  • Each Member Operator operates its respective cable cars, lifts, pistes and other facilities independently and under its own legal responsibility. The Member Operator selling the NÖ Bergerlebnispass does not act on behalf of, and shall not be liable for, the other Member Operators. It merely serves as a point of sale. The purchase of the NÖ Bergerlebnispass entitles the holder to use the services offered by the Member Operators. The specific contract for use and/or carriage shall therefore be concluded exclusively with the Member Operator whose facilities are being used at the relevant time. The fare regulations and conditions of carriage applicable in the respective ski resort must therefore be observed. Any liability towards guests, whether arising under contract or by law, in connection with incidents occurring during the operation or use of cable cars, lifts, pistes or other facilities shall lie exclusively with the Member Operator within whose area of responsibility the incident occurred. Liability of the other Member Operators is excluded. Where facilities are located within or adjacent to the ski resort of a Member Operator but are legally owned or operated by another entity that has not signed the NÖ Bergerlebnispass agreement, yet accept the NÖ Bergerlebnispass on the basis of an internal pooling arrangement (“Sub-Partners”), the Member Operator within whose sphere of influence such facilities are located shall assume all liability obligations in the event of the Sub-Partner’s insolvency.
  • The closure of individual facilities during the season or of all facilities at the end of the season due to snow conditions or weather conditions remains expressly reserved. No entitlement to a refund shall arise as a result.
  • There shall be no entitlement to a refund, price reduction, extension of the validity period or other compensation where individual Member Operators or their facilities are temporarily or throughout the entire season unavailable or only available to a limited extent due to weather conditions, lack of snow, natural events, force majeure, official orders, technical defects, safety reasons or other circumstances beyond the control of the respective Member Operator, provided that at least one Member Operator remains operational during the respective season.
  • Likewise, there shall be no entitlement to a refund, price reduction or other compensation where individual Member Operators or facilities do not commence or continue operations, or do not do so in a timely manner, due to cessation of business, insolvency, liquidation, sale of the business, change of operator, absence or delay of legal succession, official prohibition or other economic or legal reasons. This shall also apply where the respective resort is unavailable throughout the entire season.

4. Conditions of Use

  • The NÖ Bergerlebnispass may be used only during the advertised winter season of the respective participating Member Operators. During its period of validity, Pass Holders are entitled, during the respective opening hours, to use all cable car and lift facilities of the Member Operators that are in operation at the time. The services and facilities currently available can be found at the respective ticket offices, on electronic panorama information boards, through the respective information channels of the ski resorts, at the individual lift facilities and online.
  • In the event of operational closures affecting individual Member Operators, whether partially or entirely and irrespective of the reason, there shall be no entitlement to any refund, including any pro-rata refund.
  • There is no entitlement to have all participating resorts or facilities open or operational throughout the entire season. Restrictions or complete cessation of operations, whether due to weather, official orders, technical reasons, safety considerations or economic reasons, shall not give rise to any entitlement to a refund, price reduction or extension of the season pass.
  • The NÖ Bergerlebnispass does not confer any entitlement to participate in special events, special services or other services provided outside the regular operating and opening hours of the Member Operators. Whether and to what extent the NÖ Bergerlebnispass is accepted as valid admission or transport entitlement for such events or special services shall be at the sole discretion of the respective Member Operator. No legal entitlement to acceptance of the NÖ Bergerlebnispass exists in such cases.

5. Loss / Theft / Forgotten Pass

  • In the event of loss, theft or forgetting the pass, the Pass Holder is obliged to notify a Member Operator immediately so that the lost, stolen or forgotten pass can be blocked without delay and a replacement pass can be issued. A replacement pass shall be issued only if the loss has been reported before any misuse of the pass has occurred. A blocked pass shall only be reactivated following approval by the coordinator of ARGE NÖ Bergerlebnispass or by a Member Operator. In order to ensure that the blocking request can be verified and distributed, a waiting period of one day must be observed. For the issue of a replacement pass, the Customer shall pay a processing fee of EUR 25.00 and EUR 5.00 for the Keycard.

6. Refunds

Accident / Illness
  • In the event of an accident or illness resulting in an impairment of health lasting at least five weeks, a refund shall be granted in accordance with the calculation method set out below.
  • In order to claim a refund, the Pass Holder must submit a medical certificate stating the duration of the impairment caused by the accident or illness, together with the NÖ Bergerlebnispass. No entitlement to a refund shall arise until such medical certificate has been submitted.
  • Refunds shall be granted only in cases of injuries connected with skiing accidents or illness. A specialist medical certificate or accident report must be submitted and made available for settlement purposes.
  • A refund is excluded in all cases where the pass has already been used on 10 days or more.
  • A refund is excluded if the pass has been used after 28 February.
  • No refund is possible after 31 March.
  • Any refunds granted are purely discretionary goodwill payments and shall not establish any legal entitlement for the future.
  • Where a parent’s pass is refunded, any free children’s season passes and MINI passes issued in connection with it must also be returned. Any use of the children’s tickets shall be deducted from the refund amount in accordance with the rates stated below.
  • At the Pass Holder’s request, free children’s season passes and MINI passes issued in connection with the parent’s pass may continue to be used instead of being returned. In such case, the Super Early Bird price applicable to the relevant children’s season passes at the time the parent’s pass was purchased shall be deducted from the refund amount for each children’s pass that continues to be used. If the calculated refund amount is lower than the total value of the children’s season passes that continue to be used, there shall be no entitlement to a refund. In such case, the free children’s season passes and MINI passes shall remain with the Pass Holder and may continue to be used in accordance with the applicable terms.
  • Any second adult pass purchased in connection with the relevant family arrangement cannot be refunded in this context.
  • For each day of skiing already used, the following amount shall be deducted from the purchase price:
    Adult EUR 54.00 / Child EUR 33.00
    If this amount exceeds the purchase price, no refund shall be granted.
Processing Fee
  • A processing fee of EUR 25.00 per ticket shall be charged for processing pro-rata refunds and shall be deducted from the refund amount. If the refund entitlement is lower than the processing fee, the processing fee shall be invoiced to the claimant.
Non-use of the Services Offered
  • It is expressly stated that no full or pro-rata refund may be claimed where the Member Operators are ready and able to provide their services but the Pass Holder does not use those services for personal reasons or as a result of a personal decision. Accordingly, if official measures are imposed as a condition for the use of the services (e.g. an obligation to provide a negative test result, proof of vaccination, etc.) and the Pass Holder is unable or unwilling to provide such evidence, no entitlement to a full or pro-rata refund shall arise. This exclusion applies to all ticket categories.
Refund of Unused Season Passes
  • If the season pass has not been used at all during the entire season due to an injury or illness that occurred only after the season pass was purchased, the purchase price shall be refunded. A processing fee of EUR 25.00 per ticket shall be charged. In all other respects, the same conditions as for a standard refund shall apply. No refund is possible after 31 March.
  • If any associated free children’s passes have already been used, the Super Early Bird price applicable to the corresponding children’s passes shall be deducted from the refund amount.

7. Misuse

  • Any misuse of the NÖ Bergerlebnispass shall result in the immediate blocking of the pass without compensation. Misuse shall include, in particular, the actual or attempted transfer of the NÖ Bergerlebnispass to third parties or use thereof by third parties, obtaining the pass by providing incorrect information regarding main residence, age, etc., or obtaining the pass by submitting false certificates or other false evidence. In the event of misuse, the Customer shall additionally be obliged to pay a contractual penalty of EUR 250.00 to the Member Operator at which the misuse was discovered. The Member Operator concerned also reserves the right to file a criminal complaint.
  • If a season pass blocked due to misuse is reactivated at the Pass Holder’s request, the Pass Holder shall, in addition to the contractual penalty imposed, pay a reactivation fee of EUR 54.00 for adults or EUR 33.00 per established case of misuse.

9. Defective Data Carrier

  • If a NÖ Bergerlebnispass data carrier (Keycard) is not accepted at a turnstile although the pass is valid, the Member Operator in whose resort the malfunction occurs shall issue a replacement card. The Customer shall again pay EUR 5.00 for the new Keycard unless an undamaged NÖ Bergerlebnispass Keycard is returned to the Member Operator. A processing fee of EUR 25.00 per ticket shall also be charged.

10. Damages

  • Claims for damages in cases of slight negligence are excluded. This exclusion shall not apply to personal injury. In all other respects, the fare regulations and conditions of carriage of the respective Member Operators shall apply.

11. Jurisdiction / Applicable Law

  • For any legal action arising from this contract brought against a consumer whose domicile, habitual residence or place of employment is in Austria, jurisdiction shall lie with any court within whose judicial district the consumer has their domicile, habitual residence or place of employment. For consumers who do not have a domicile in Austria at the time the contract is concluded, the statutory rules on jurisdiction shall apply. Austrian substantive law shall apply.
  • The contractual language is German. Only the German version of these GTC is legally binding.
  • The Operator reserves the right to amend these GTC from time to time. Any such amendment shall apply exclusively to future ticket purchases. The version applicable at the time of purchase shall apply. This shall also apply throughout the entire validity period of the respective ticket.

12. Change of Address

  • In the event of a change of residence, the Customer is obliged to notify the relevant operator of the new residential address within 14 days.
