General Terms and Conditions (GTC) and Scope of Application

These General Terms and Conditions govern the contractual relationship between ARGE NÖ Bergerlebnispass, consisting of the lift companies listed at the end of these General Terms and Conditions (hereinafter referred to as “member companies”), and the natural persons (hereinafter referred to as “customers or holders”) who purchase the NÖ Bergerlebnispass. By purchasing and using the NÖ Bergerlebnispass, the customer expressly accepts these terms and conditions. In addition, the conditions of carriage of the member company whose lift and ski slope facilities—including ancillary facilities—are specifically used by the holder of the NÖ Bergerlebnispass apply.

1. Eligibility and use of the NÖ Bergerlebnispass

Responsible for data processing:

  • All persons are generally entitled to purchase the NÖ Bergerlebnispass. They will be charged the standard rate according to the price list.
  • There is no entitlement to a free NÖ Bergerlebnispass für Kleinkinder (Damit sind Kinder gemeint, die auf Grund ihres Geburtsdatums noch nicht die Jahrgangsgrenzen laut NÖ Bergerlebnispass-Preisliste für Kinderkarten erreichen). for small children (this refers to children who, due to their date of birth, do not yet meet the age requirements for children's tickets according to the NÖ Bergerlebnispass price list).
    If an adult in a family purchases a NÖ Bergerlebnispass, children under the age of 6 in the family receive the MINI NÖ Bergerlebnispass. The individual fare regulations of the individual ski resorts apply to the transport of small children.
  • The age groups for each category can be found on the website.
  • Persons with a disability rating of 70% or higher are considered disabled (proof must be provided by submitting the original social security confirmation) and receive special rates.
  • The NÖ Bergerlebnispass is valid for one person only and will only be issued after payment of the purchase price and provision of your surname, first name, date of birth, address, and a photograph. The photo and your first and last names will be digitally printed in the designated field via the cash register system.   • The pass is non-transferable, even within the family.
  • The NÖ Bergerlebnispass is only available on contactless data carriers. A keycard costs €5.00 and is a deposit card. The functional “Keycard ISO Dual” can also be reused next year. If a keycard does not work, the data can be transferred to a new card, but a fee of €5.00 plus a processing fee of €25 must also be paid for the purchase of the new card. The customer will receive a refund of €5.00 for the respective keycard when returning the undamaged data carrier at the ticket office. To use the facilities of the NÖ Bergerlebnispass, the customer must always carry the NÖ Bergerlebnispass with them and present it on request, together with photo ID.

2. Purchase and withdrawal

The card can be purchased as follows:

  • Purchase the card directly at the ski resort: The customer pays for and receives the desired NÖ Bergerlebnispass directly at the ticket office of a ski resort that is designated as a point of sale.
  • Purchasing the card via the online store: Ski resorts belonging to ARGE NÖ Bergerlebnispass are free to sell the NÖ Bergerlebnispass via their online stores. All data relevant to the issuance of the personalized card will be requested in the respective online store. Once the order process is complete, the customer will receive a summary of their order and then have the option to complete the purchase via online payment. After successful payment, the customer will receive both the invoice and an order confirmation with the pickup code, if applicable, to the email address they provided. With this pickup code, the card can be picked up at all ticket offices of the ski resort where the customer purchased the card in the web shop after no more than 0.5 hours.
  • Purchase of the card via email to info@bergerlebnispass.at: Once the data required for issuing the card has been sent to ARGE NÖ Bergerlebnispass via email, payment can be made by direct debit. The card will then be sent as described in the previous point once payment has been received.
  • Withdrawal from the purchase is generally excluded, as stated in point 3. Special conditions are listed in point 8, Refunds.

3. Rates and liability

  • The prices applicable to the NÖ Bergerlebnisspass are determined for each season.
  • An exchange for another ski pass, transfer to another person, or change of validity period is not possible after purchase.
  • The holder of the NÖ Bergerlebnisspass is obliged to store the pass in such a way that no third parties can access it, in order to prevent misuse, loss, or theft.
  • There is no entitlement to a refund in the event of bad weather, early departure, illness (except as stated in section 6), avalanche danger, failure or interruption of operations, or closure of ski slopes.
  • Each member company operates its respective cable car and lift facilities, slopes, and other installations independently and under its own legal responsibility. The member company that sells the NÖ Bergerlebnisspass acts solely as a point of sale and neither represents nor assumes liability for other member companies. The purchase of the NÖ Bergerlebnisspass entitles the holder to use the services offered by the member companies. The specific service contract (usage or transport contract) is therefore concluded only with the member company whose facilities are currently being used. Accordingly, the applicable prices and transport regulations of the respective ski area must be observed. Any liability towards guests—whether based on contractual or statutory provisions—for incidents arising from or during the operation and use of cable car and lift facilities, slopes, or other installations rests exclusively with the member company responsible for the area in which the incident occurred. Liability of the other member companies is excluded.
  • For facilities located within or adjacent to the ski area of a member company but not legally belonging to the company that signed the NÖ Bergerlebnisspass agreement, yet included in the pass through an internal pool arrangement (“sub-partners”), the member company within whose sphere of influence these facilities lie assumes all liability obligations in the event of insolvency of the sub-partner.
  • The suspension of operations of individual facilities during the season or of all facilities at the end of the season due to snow or weather conditions remains reserved. No entitlement to a refund arises in such cases.

4. Terms of Use

  • The NÖ Bergerlebnisspass is only valid during the designated winter season of the participating member companies. During the validity period, cardholders are entitled to use all cable car and lift facilities of the member companies that are in operation during their respective opening hours. The available services are announced daily at the respective ticket offices, on electronic panorama boards, through the ski area’s information channels, and online.
  • In the event of operational closures of individual member companies (partial or complete) – regardless of the reason – there is no (including no proportional) entitlement to a refund.
  • There is no entitlement to the assumption that all areas or facilities will be open or in operation throughout the entire season. Restrictions or complete closure of operations – whether due to weather conditions, official orders, technical, safety-related, or economic reasons – do not entitle the holder to any refund, price reduction, or extension of the season pass.

5. Lost/Theft/Forgotten

In the event of loss, theft, or forgetting, the cardholder is obliged to report this immediately to a member company so that the lost or stolen card can be blocked, and a replacement card can be issued. A new card will only be issued if the report is made before any misuse of the card has occurred.

A card will only be unblocked once approval has been granted by the coordinator of the ARGE NÖ Bergerlebnisspass or a member company. To ensure proper verification and processing of the block, a waiting period of one day must be observed.

For the issuance of a replacement card, a processing fee of Euro 25.00 and Euro 5.00 for the Keycard must be paid by the customer.

6. Refunds

Accident/Illness

  • In the event of an accident or illness resulting in a health impairment lasting at least five weeks, a refund will be granted according to the calculation formula stated below.
  • To claim a refund, the user must present a medical certificate (in the case of an accident or illness indicating the duration of the health impairment) as well as the NÖ Bergerlebnisspass. Until the medical certificate is provided, no entitlement to a refund exists.
  • A refund is excluded if the pass has already been used on 10 days or more.
  • A refund for use after February 28 is excluded.
  • A refund after April 1 is not possible.
  • Any refunds granted are purely goodwill gestures and do not establish any legal claim for the future.
  • In the case of a refund for the parent pass, the child season tickets and mini passes must also be returned. The usage of the child tickets will be deducted from the refund amount according to the rates listed below.
  • For paid child passes, the return is optional.
  • A possible second adult pass will not be refunded in this context.
  • For each day of use, the following amount will be deducted from the purchase price:
    • Adult € 50.–
    • Child € 30.–
    • If this amount exceeds the purchase price, no refund will be granted.

Processing Fee

For the processing of partial refunds, a handling fee of EUR 25.– will be deducted from the refund amount. If the refund claim is lower than the handling fee, the claimant will be charged the difference.

Processing Fee

It is expressly stated that no (proportional) refund can be claimed if the member companies are willing to provide services but the cardholder does not make use of these services due to personal considerations/decisions. Therefore, if, for example, official measures are imposed for the use of the services (e.g., obligation to present proof of a negative test, proof of vaccination, etc.) and the cardholder is unable or unwilling to provide this proof, no claim for a (proportional) refund can be made. This exclusion applies to all card categories.

Refund of unused season tickets

If the season ticket has not been used throughout the season due to injury or illness, it will be refunded (purchase price). However, the processing fee will be charged. Otherwise, the same conditions apply as for normal refunds. Refunds after April 1 are not possible.

7. Abuse

Any misuse of the NÖ Bergerlebnisspass will result in the immediate and irrevocable suspension of the pass. Misuse includes, in particular, the (attempted) transfer and use of the NÖ Bergerlebnispass to/by third parties, acquisition through incorrect information about primary residence, age, etc., or if it was obtained by presenting false confirmations.

In the event of misuse, the customer is also obliged to pay a contractual penalty of EUR 250.00 to the member company concerned (where the misuse was discovered). The member company concerned also reserves the right to file a criminal complaint. If a season ticket that has been blocked due to misuse is unblocked at the request of the cardholder, an additional unblocking fee of €50 for adults or €30 per instance of misuse will be charged to the cardholder in addition to the penalty fee imposed.

8. Defective data carriers

If a NÖ Bergerlebnispass data carrier (keycard) is not accepted at the turnstile even though the card is valid, a “new card” must be issued by the member company in whose area the error occurs. The customer must pay a fee of EUR 5.00 for the new keycard, unless an undamaged NÖ Bergerlebnispass keycard is returned to the member company.

9. Compensation of Damages

Claims for damages in cases of slight negligence are excluded. This does not apply to personal injury. In all other respects, the price and transport regulations of the respective member companies apply.

10. Place of Jurisdiction / Applicable Law

  • For all actions brought against a consumer who has his residence, habitual residence, or place of employment within Austria, the court in whose jurisdiction the consumer’s residence, habitual residence, or place of employment is located shall have jurisdiction. For consumers who do not have a residence in Austria at the time of the conclusion of the contract, the statutory places of jurisdiction apply. Austrian substantive law shall apply.
  • The contractual language is German. Only the German version of these Terms and Conditions is legally binding.
  • The operator reserves the right to amend these Terms and Conditions from time to time. Such amendments shall only apply to future ticket purchases. The version in effect at the time of ticket purchase applies. This also applies for the entire validity period of a ticket.

11. Change of Adress

In the event of a change of residence, the customer is obliged to notify the new address within 14 days.
